BOOKING FEE – A booking fee is required to secure the services of Image Eight for your date. The Booking Fee is non refundable and is deducted (in full) from the Total Price on completion of the contract. When the initial deposit is made, the contract is entered into in agreement with these terms and conditions.
INDEMNITY – Image Eight shall not be liable for any legal action, claim or damages resulting from or arising out of the publication of the photographs or other use by the client. The client shall indemnify Image Eight against any claims and/or damages against them as a result of the clients use of the photographs. Image Eight shall not be liable for any damages, losses, death or personal injury. The Client accepts full responsibility for any materials that they supply for use in the photographs and that the materials are adequately insured against loss, damage or liability.
CONTENT – Image Eight and subsidiary company Media Toolbox shall be permitted to use any photograph included in this contract as promotional material without payment of any fee. (This will include publication on the internet, entry in photographic contests or art exhibitions.) We respect your privacy and therefore do not sell, rent or loan any identifiable information regarding its customers to any third parties.
PHOTOGRAPHS –Digital retouching, enhancement, and finishing are available at extra cost.
RE-ORDERS - All re-orders shall be treated as an extension of this contract. No responsibility for error will be accepted unless orders are given in writing.
COPYRIGHTS - The 1988 Copyright Act assigns the copyright to The Photographers. It is contrary to the Act to copy, or allow to be copied, any photographs covered by this contract. Previews and Proofs remain the property of the Image Eight unless otherwise specifically contracted in writing. Negatives and/or Digital Files are kept on active file for six months after which a search fee supplement will be charged in addition to the prices in effect at the time. Negatives and/or Digital Files remain the property of Image Eight and shall normally be kept for not less than 3 years from the wedding date.
LICENCE - The Photographers shall be granted artistic license in relation to the poses photographed and the locations used. The Photographers’ judgment regarding locations, poses and number of photographs taken shall be deemed correct. No single picture can be guaranteed although the Photographer will always try to give the Client everything wanted.
PRICES – Where the booking is 12 months or more in advance, Image Eight reserves the right to increase prices to cover increased costs, etc. The price of your minimum order will never be increased by more than 7.5% unless the booking is made 18 or more months in advance when any increase will be limited to 15%. Should there be any variations to the GST system, Image Eight reserves the right to adjust any prices which may be affected.
FORCE MAJEURE or ACT OF GOD – The due performance of this contract is subject to alteration or cancellation by Image Eight. In the unlikely event of total photographic failure or cancellation of this contract, Image Eight and the Photographers’ liability shall be restricted to the refund of all monies paid.
CANCELLATION – Only cancellations in writing can be accepted. In the event that The Client cancels the contract by giving written notice the booking fee shall be forfeited.
COMPLAINTS – We garantee that the delivered product will be free from defects in materials and workmanship, but if for some reason you are not satisfied, we’re happy to discuss your concerns. Any complaints should first be raised with Image Eight in writing within 21 days from receipt of the photographs.
